Effective date: 3 October 2026
§1. Definitions
The following terms used in this document have the following meaning:
- Service - the HeyQuiz platform available at heyquiz.pro (information site and participant join pages) and app.heyquiz.pro (the Client panel), enabling the creation and hosting of interactive quizzes and presentations with Participants.
- Operator - AHYEON Tomasz Sawko, ul. Skarbka z Gór 122c/13, 03-287 Warszawa, Poland, tax id (NIP) 7181665800, operating the Service. Contact: support@heyquiz.pro.

- Participant - a person taking part in a Session (joining with a code, link or QR code) who does not need an Account. A Participant uses the Service at the invitation of a Client.
- Quiz - a set of questions created in the Service (up to 9 question types, including "raise hand", poll and open question) together with its scoring settings.
- Session - one run of a Quiz or Presentation with Participants: live (Live or Self-paced mode), asynchronously (an Assignment with a time window), as an Expo Event (a booth with a QR code) or as a Presentation show. A test session is a trial run with a limited number of Participants and duration.

§2. General provisions
These Terms define the rules of using the Service. The Service is governed by Polish law. Using the Service is voluntary and constitutes acceptance of these Terms. The Operator provides services electronically within the meaning of the Polish Act of 18 July 2002 on the provision of electronic services. Creating an Account requires being at least 16 years old; persons under 18 may use the Service only with the consent of a legal guardian. Taking part in a Session as a Participant does not require an Account - §12 and §13 apply to Participants to the extent they concern their conduct.
§3. Scope of services
The Service allows Clients to:
- create, edit, clone, import and export Quizzes (JSON, Excel) using up to 9 question types and several scoring modes, including team mode
- run live Sessions (Live and Self-paced modes) with a lobby, join code, QR code, server-synchronised timer, live ranking and podium, also remotely from a phone (Remote Pilot)
- share Quizzes for self-paced completion within a time window (Assignments), including - in the Summit plan - through named links with invitation delivery
- run Expo Events at trade-show and conference booths (a kiosk with a QR code, rounds, prize pick-up codes, a booth staff panel)
- import Presentations from PDF, PPT and PPTX files, annotate them and present them with quiz questions
- apply Branding profiles to Session screens and hand out prizes and collect Participant data (a form before joining) - scope depends on the Plan
- get Session reports (PDF, Excel), a grading queue for open questions, and report analysis with AI Assist
- run test sessions (up to 3 Participants, 15 minutes) without consuming limits
- run a multi-user Organization in the Summit plan: invitations, roles, an Organization content library, webhooks, parallel sessions
- use AI Assists within the monthly pool of the Plan
The availability of individual features depends on the Client's Subscription plan, as per §5. The Operator reserves the right to modify, extend or limit the scope of the Service's features, of which Clients will be informed with reasonable notice.
§4. Account and Organization
- Registering an Account requires a valid e-mail address (or authentication via Google or Apple), a name, and acceptance of the Terms and the Privacy Policy. Registration creates an Organization in the Party plan without any purchase decision. One e-mail address can be linked to only one Account and one Organization; creating multiple Accounts by one person to bypass limits or the Trial is not allowed.
- Starting the Trial and the first production Session requires prior verification of the e-mail address.
- The Client bears sole responsibility for the security of their login credentials and should immediately inform the Operator of any unauthorised access to the Account. The Service offers two-factor authentication (TOTP) and notifies about sign-ins from new devices. The Operator recommends enabling 2FA but is not liable for the consequences of not doing so.
- In the Summit plan the Owner invites members to the Organization by e-mail. The invitee registers on the standard registration page; their e-mail address is deemed verified. Removing a member from the Organization means deleting their Account; the content they created stays in the Organization under the Owner's care.
- The Owner may transfer the ownership of the Organization to another Host; the transfer requires confirmation by both parties within a set time.
- Regaining access to an Account (lost password, no access to the mailbox or the 2FA app) happens through the standard mechanisms of the Service and, in exceptional cases, by contacting support@heyquiz.pro. The Operator restores access only after verifying identity; for company Organizations the verification may include proving control over the company domain the Account was registered with. The Operator may refuse to restore access when verification is not possible.
§5. Subscription plans
The Service offers three Subscription plans and the Event Pass:
- Party - a free plan for private use, with a limited number of Quizzes, questions per Quiz, Participants per Session, question types and AI Assists, and without the Self-paced, Asynchronous and Expo modes, reports, presentations, branding, prizes and Participant data collection.
- Stage - a paid plan for educators, trainers and freelancers: unlimited Quizzes and questions, all question types and scoring modes, Self-paced and Asynchronous modes, reports, import/export, Presentations and file storage, test sessions, a higher Participant limit and more AI Assists.
- Summit - a paid plan for companies and teams, in variants differing by the Participant limit per Session: everything in Stage plus Expo mode, Branding profiles, prizes, Participant data collection, webhooks, named links and invitation delivery, the Organization library, Seats for Hosts (included and purchasable), Viewers, parallel sessions, more file storage, a larger AI Assist pool with the option to use your own API key.
- Event Pass - one-off access to Summit-level features for a single event, as per §9.
Current prices, exact limits and a detailed comparison of the Plans will be published at heyquiz.pro once sales of paid Plans open. The published price list forms an integral part of these Terms. Prices are quoted in USD net; annual payment is cheaper than monthly. The Operator reserves the right to change the prices and limits of the Plans; Clients will be notified of price changes at least 30 days before they take effect, and a price change does not affect the current, paid billing period. Variants above the largest Summit tier and individual contracts are priced individually.
§6. Trial
- A Client may start, once and on demand from the panel, a 14-day Trial. The Trial requires choosing a target plan (Stage or Summit with a chosen tier) and providing a payment method in the Paddle checkout. After the Trial ends the chosen Plan is charged automatically; cancelling before the end of the Trial means no charge. The Operator reminds about the upcoming end of the Trial by e-mail.
- The Trial has its own limits (including Participants per Session, number of live Sessions, AI Assists, Seats, Assignments, Presentations and storage) independent of the target plan; it does not include Expo mode, named links or invitation delivery. The full limits of the Plan apply from the first payment.
- One Trial per Account and Organization. The Operator may refuse or end a Trial when it detects an attempt to use it repeatedly (e.g. successive Accounts from the same company domain within a short time, or the same payment method). For a one-off event the Operator offers the Event Pass (§9); larger testing needs (e.g. a Session for several hundred people) can be arranged individually via support@heyquiz.pro.
§7. Payments and billing
Paid Plans, extra Seats and the Event Pass are billed through Paddle.com Market Ltd, which acts as the Merchant of Record for all transactions, issues invoices and provides the customer portal. The listed prices exclude tax; the final amount may include VAT or another tax charged by Paddle at checkout according to the Client's location. A subscription can be cancelled at any time on the Billing page of the Service; cancellation takes effect at the end of the current billing period, until which the Client keeps full access to the Plan's features. No refunds for partial billing periods. When upgrading the Plan mid-period the difference is prorated; a downgrade takes effect at the end of the paid period. After a failed payment the Client keeps full access for 7 days, then read-only access for another 7 days; after that, without a successful payment, the Organization returns to the Party plan as per §8. After cancelling a subscription, once the paid period ends, the same path applies without the first 7 days of full access. Paddle handles refund requests in line with its buyer terms; to request a refund write to support@heyquiz.pro within 14 days of the charge. The Event Pass is a one-off purchase: an unused pass may qualify for a refund within 14 days of purchase; once a production event has been started it is non-refundable.
§8. Downgrading the Plan - "nothing is lost"
After a downgrade (including the end of a Trial without conversion, a failed payment or an expired Event Pass) the newest Quizzes and Presentations up to the limit of the new Plan stay active; the excess becomes read-only (viewing and export, no Sessions) and returns to full functionality once the Plan is upgraded again. Features unavailable in the new Plan (branding, prizes, data collection, webhooks) stop working, but their configuration and data stay in the Service subject to retention and return after an upgrade. Participant data from completed Sessions stays available for reading and export regardless of the Plan, until it is removed under the configured retention. When moving from Summit to Stage or Party the Owner stays and the Accounts of Hosts and Viewers are deleted; their content goes under the Owner's care and their running Sessions are ended.
§9. Event Pass
The Event Pass gives immediate, 14-day access to Summit-level features (including Expo, branding, prizes and data collection) for one Account, for a single event: one production live Session or one Expo Event. Once a production Session has been started, another production start is blocked until the pass expires - the Service says so before the start and asks for confirmation. Test sessions do not consume the event. The Event Pass does not include Assignments, webhooks, Seats or Viewers. After 14 days the Organization returns to its base plan (Party or the active subscription) and its content is subject to §8. The Event Pass can be bought repeatedly; it does not combine with an active Summit subscription.
§10. Participants and Participant data
- A Participant joins a Session without an Account, giving a nickname (or the details required by the Client, if the Client enabled data collection). The Service processes answers, results, response times and - in Expo Events - prize pick-up codes and leads, on behalf of and as instructed by the Client who organises the Session.
- With regard to Participant data the Client is the data controller and the Operator the processor. The terms of processing are set out in the Data Processing Agreement, available for review and acceptance in the Organization panel (Owner) and publicly in the Service. The Client is responsible for the legal basis of collecting Participant data, the wording of consents, informing Participants, and the legality of prizes and contests.
- Participant data is anonymised automatically after the retention period set by the Organization Owner (7 to 90 days after the Session; 30 days by default); test session results after 24 hours. Anonymised, aggregated Session statistics remain with the Quiz.
- A Participant may not use cheating tools, disrupt Sessions, impersonate other persons or use offensive or misleading nicknames. The Client may remove a Participant from a Session.
§11. AI Assists
Features marked as AI Assist (e.g. question suggestions, copy editing, report analysis) use language models provided through OpenRouter. Content is sent to the model provider only at the Client's explicit request (running an Assist), without data identifying Participants beyond what the Client puts into the content themselves, and is not used to train models. AI-generated content is auxiliary; the Client bears full responsibility for verifying and using it, and the Operator does not guarantee its accuracy or completeness. AI Assists are included in the Plans as a monthly pool whose size is stated on the pricing page; the pool renews with every billing period and unused Assists do not roll over. In the Summit plan the Client may connect their own API key (BYOK) - billing with the model provider then happens outside the Service and the Operator is not responsible for the provider's costs. Within an Organization the Assists are a shared pool; the Owner may disable them for the whole Organization.
§12. Content rules
The Client undertakes not to create, upload or share through the Service content that:
- violates applicable law or the rights of third parties
- infringes intellectual property, trademarks or copyright
- contains malware, viruses or harmful code
- is defamatory, obscene, threatening or discriminatory
- constitutes spam, phishing or social engineering, including collecting Participant data under false pretences
- contains personal data of third parties without a legal basis
- promotes illegal activities or violence
- burdens the Service infrastructure disproportionately to normal use
The Operator reserves the right to remove content violating the above rules without prior notice and, in justified cases, to suspend or delete the Account as per §18.
By uploading a font to a branding profile, the Client declares that they hold a licence permitting its use on websites (a web licence) to the extent the Service delivers the font to Participants' browsers. The Client is responsible for compliance with the licence. The Operator may remove a font file about which it receives a credible infringement report.
§13. Sharing, the Organization library and webhooks
The Client shares Sessions with Participants through a join code, link or QR code; in Assignments also through open or named links. The Client bears sole responsibility for the content shared with Participants and for whom they give access to. In the Summit plan content published to the Organization library becomes available to the other members of the Organization as copies; the author and the Owner may remove it. Webhooks are configured and used at the Client's responsibility; the Client is responsible for the security and availability of the receiving URLs, and actions performed through webhooks and exports are treated as the Client's actions. The Operator does not monitor Session content but may react to reports of violations.
§14. Intellectual property
The Service, including its source code, design, branding, name and documentation, is the intellectual property of the Operator and is protected by copyright. Clients retain full ownership of all content they create in the Service (Quizzes, Presentations, branding graphics, Session data). By using the Service the Client grants the Operator a limited, non-exclusive, royalty-free licence to store, process and display the Client's content solely for the purpose of providing the service; this licence expires when the content or the Account is deleted. The Operator does not use Client content to train AI models, for advertising or for any purpose other than providing the service.
§15. Service availability
The Operator strives to keep the Service available 24 hours a day, 7 days a week, and guarantees 99.5% availability per calendar year. The Operator monitors the Service's components to ensure they work correctly.
Reporting outages. Outages should be reported by e-mail to support@heyquiz.pro with a description of the problem and its impact on using the Service, the date and time, the browser and operating system, screenshots or error messages (if available) and the Account e-mail address.
Compensation. In the event of an outage caused by the Operator that brings the Service's availability below the guaranteed 99.5% in one calendar year, the Operator undertakes to extend the validity of the affected Client's paid Plan by 3 days for every 0.50% of downtime below the guaranteed level. Compensation is the Client's sole remedy for not meeting the guaranteed availability and is not available to Clients violating the Terms.
Maintenance windows. The Operator reserves the right to maintenance windows needed to repair or maintain infrastructure, update software, ensure security or roll out new solutions. The total duration of planned windows should not exceed 72 hours per calendar year. The Operator announces planned windows at least 24 hours in advance - on the Service's website or by e-mail - and, where possible, schedules them outside typical Session hours.
Exclusions. The availability guarantee does not apply when an outage results from force majeure (§20), an announced maintenance window, services or equipment not operated by the Operator but needed to provide the Service (e.g. infrastructure, payment or e-mail providers), the configuration or actions of the Client, Participants or third parties the Operator is not responsible for, or the Client overloading the Service beyond the Plan's limits.
§16. Liability of the Operator
The Service is provided "as is". The Operator gives no warranties beyond those expressly stated in these Terms. The Operator is not liable for: content created, uploaded or shared by Clients and Participants; decisions made on the basis of Session results or AI-generated content; the course and outcome of contests, prizes and events organised by the Client; interruptions of the Service caused by circumstances beyond the Operator's control, including the quality of Participants' connections; loss of data for reasons attributable to the Client, including the retention they configured; actions of third parties who gained access to the Client's Account through the Client's fault. To the maximum extent permitted by applicable law, the Operator's total liability towards the Client arising from the use of the Service, regardless of the legal basis, is limited to the fees paid by the Client to the Operator in the 12 months preceding the event causing the damage, and for Clients on the Party plan - to the equivalent of USD 50. The limitation of liability does not apply to damage caused intentionally or where mandatory law does not allow it.
§17. Liability of the Client
The Client bears full responsibility for all content created, uploaded and shared through their Account and Organization, including the content of Organization members, content generated with AI Assists, and the lawfulness of collecting Participant data and of organised contests. The Client undertakes not to take actions aimed at circumventing the Service's security or limits, reverse engineering or extracting source code. The Client undertakes to indemnify the Operator against any third-party claims, including claims of Participants, arising from the Client's violation of these Terms.
§18. Suspension and deletion of an Account
- The Operator may suspend or delete an Account or Organization in the event of a violation of these Terms, use of the Service contrary to its purpose, or actions threatening the security of the Service, other Clients or Participants. Where possible the Operator notifies the Client of the reasons by e-mail; in cases requiring immediate action it may act without prior notice.
- Organizations inactive for 12 consecutive months (no activity by any member) may be deleted. Before deletion the Operator sends warnings by e-mail 30, 14 and 3 days ahead; any sign-in stops the procedure. Organizations with a subscription in force, an individual contract or an active Event Pass are never deleted for inactivity. Accounts whose e-mail address is not verified within 30 days of registration are deleted without notice.
- The Owner may delete the Organization together with all its Accounts and data from the Settings page. Deletion happens after a 14-day grace period during which it can be cancelled with a link from the e-mail; before deletion the Owner may download a data export bundle. After the grace period the data is anonymised and removed from the Service within 30 days, in line with the Privacy Policy. Deletion is irreversible.
- Deleting a single member Account (removal) happens at the Owner's request as per §4(4).
§19. Complaints
Complaints about the operation of the Service can be submitted by e-mail to support@heyquiz.pro. A complaint should include a description of the problem, the date it occurred and the Client's contact details. The Operator will consider the complaint and reply within 14 calendar days of receiving it. Clients who are consumers under Polish law may use out-of-court dispute resolution methods, including the European Commission's ODR platform at https://ec.europa.eu/consumers/odr/.
§20. Force majeure
The Operator is not liable for non-performance or improper performance of obligations under these Terms if caused by force majeure. Force majeure means external, extraordinary and unpreventable events, in particular natural disasters, epidemics, acts of war, acts of terrorism, strikes, failures of telecommunications or power infrastructure of national or international scale, and decisions of public authorities preventing the provision of services. The Operator will notify Clients of force majeure promptly after becoming aware of it.
§21. Personal data and cookies
The Operator processes the personal data of Clients and Participants in accordance with the Privacy Policy, which also describes the cookies used. The Privacy Policy is available in the Service and forms an integral part of these Terms.
§22. Changes to the Terms
The Operator reserves the right to change these Terms. Clients will be notified of material changes by e-mail (technical list, no marketing consent required) at least 14 days before the changes take effect. Every version of the Terms carries a version label and an effective date; the version accepted at registration is recorded on the Account. Continued use of the Service after the effective date constitutes acceptance of the new Terms. A Client who does not accept the changes has the right to delete the Organization before the changes take effect.
§23. Final provisions and contact
These Terms are governed by Polish law. Matters not regulated herein are governed by the relevant provisions of Polish law, including the Civil Code, the Act on the provision of electronic services and the GDPR. The parties will seek to resolve disputes amicably; failing agreement, disputes are settled by the court competent for the Operator's seat in Warsaw, which does not limit consumer rights under mandatory law. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force (severability clause). The Terms are drawn up in Polish and English; in the event of discrepancies the Polish version prevails. Contact with the Operator: support@heyquiz.pro.
